Homeless Felon, With Long Criminal History, Faces Nashua Burglary, Stalking, Drug Charges

NASHUA, NH — A homeless woman from Concord, now located in Nashua, with a lengthy criminal history, is facing new charges after being accused of burglary, stalking, and drug possession.

Around 11 a.m. on Monday, police were sent to Amherst Street for a report of a possible restraining order violation. A man in an apartment in the building said he was away for the weekend, and when he returned home, he noticed the door to his apartment was locked, but a spare key was lodged inside the lock. The man told police the only person who had access to the spare key was Desiree Charter, 38, and she had yet to return it, an affidavit stated.

When he entered the apartment, “it was in disarray,” the report stated, with drug paraphernalia and candy wrappers strewn around. The wrappers, he said, were of a candy that was Charter’s favorite. Her ID and iPad, which were not in the home previously, were located inside, the report stated. The affidavit stated the man said his computer, a backpack, and seven personal checks written out to “Desiree Charter,” which he did not make out or sign, were also in the apartment.

Around 9:30 a.m. on Tuesday, three officers were called back to the building for a report of a burglary in progress.

The complainant told police Charter was breaking into his apartment through a window after pushing in an air conditioner, the report stated. The man locked himself inside the apartment’s bathroom. Officers arrested Charter on a warrant and, while speaking with the man, found the backpack that was reported stolen the previous day, a detective wrote.

During booking, police accused Charter of having two bags of drugs — heroin-fentanyl and methamphetamine. She had previously been convicted on a drug charge in Merrimack County Superior Court in May, an officer noted.

Two detectives spoke with the man at police headquarters and he signed a consent form to search and process his apartment. He denied permitting Charter to enter his apartment but did say he was considering dropping the restraining order after an upcoming court date. The man also provided police with a voicemail he claimed to be Charter from around 11 p.m. on Sunday night.

“(The victim) said that he believed Desiree was in his apartment at this time because he could hear a television in the background,” a detective wrote.

Detectives returned to the apartment to process the scene and reportedly discovered the stolen laptop and a checkbook belonging to the man inside the backpack. Another detective reviewed the active stalking order from June 28 and confirmed Charter was served with it, the report said.

Charter agreed to be interviewed after being arrested on burglary, meth possession, and fentanyl-heroin possession counts, all felonies, as well as criminal trespass, two stalking, and two violation of protective order charges. After being Mirandized, she confirmed the active restraining order and the voicemail message but countered that the man said he had dropped it and was letting her stay with him, the affidavit said. She claimed the victim was at the apartment at the time of the voicemail, the report stated. Charter was accused of admitting to taking the laptop but said she was unaware the checkbook was in the backpack.

Detectives requested a consent search of her wallet, which was obtained, and they found three checks inside as well a credit card belonging to the man, the affidavit stated. Charter also gave detectives access to her Google account, saying she had recordings and text messages that would contradict the allegations “but was still unable to provide detectives any further evidence,” the report stated.

Charter was arraigned in Nashua District Court on Wednesday and held on preventative detention.

Charter has a criminal history dating back more than 15 years, after she was arrested on four acts prohibited drug charges in Hudson. In March 2011, on an interference with custody charge out of Barnstead and theft in Pittsfield, and violated her probation or parole four times.

In 2013 and 2014, she was arrested on forgery, theft, acts prohibited, false report of a motor vehicle accident, driving after revocation or suspension, theft by deception-$1,001 to $1,501, and organized retail crime enterprise charges in Concord. She also violated her probation and parole on several of these cases, reported stated.

In December 2015, Charter was arrested on 10 theft by deception charges connected to two incidents in Concord and in March 2019, she was arrested on another felony theft charge in Concord. More acts prohibited drug charges were issued out of Concord in February 2022. Another theft arrested in Concord was reported in March 2023 while drug and resisting charges in May 2023 and reckless conduct in June 2023 out of Concord were issued.

Charter also has a pending felony theft charge out of Tilton from January. She failed to appear in court last week, but a bail hearing was held on Wednesday. Charter is due back in the superior court in Grafton County on Aug. 28.

In the most recent drug conviction on May 10, involving three acts prohibited charges in Concord during two separate incidents in January, she pleaded guilty to two two-year sentences with a mandatory minimum of one year and a $620 fine, all suspended for three years.
